Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you (“you,” “Guest,” whether acting personally or for an entity) and Komorebi Travel LLP (“the Company,” “we,” “us,” “our”), covering your access to and use of our website, enquiry and booking services, reviews features, and participation in our journeys.

1. Acceptance

By accessing our website, submitting an enquiry, or making a payment, you confirm you have read and agree to these Terms, together with our Terms and Conditions (trip-specific rules), Refund Policy, and Privacy Policy, each incorporated by reference. If you do not agree, please do not use our services. We may update these Terms from time to time; the version in force when you transact governs that transaction, and continued use after an update means you accept the revised Terms.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to book with us. By using our services you confirm that the information you provide is true, accurate, and complete, and that your use complies with all laws applicable to you.

3. Intellectual property

Our content: The website and its content, including text, itineraries, trip designs, photographs, video, graphics, logos, and software, are owned or licensed by us and protected by intellectual property law.

Limited licence to you: We grant you a limited, personal, non-commercial, revocable licence to view our content for the purpose of planning and booking a journey.

Restrictions: You may not copy, republish, sell, scrape, or reproduce our itineraries or proprietary content, or use them to build a competing product, without our prior written consent.

4. Reviews and user content

Our site lets you submit reviews, ratings, comments, and photos (“User Content”). You keep ownership of your User Content, and you grant us a worldwide, royalty-free, non-exclusive licence to host, display, reproduce, and use it to promote our journeys, with attribution where practical.

By posting User Content, you confirm that:

• it is your own work or you have the rights to share it, and it does not infringe anyone’s rights;
• it is honest and reflects a genuine experience;
• it is not unlawful, defamatory, obscene, hateful, misleading, or an invasion of privacy, and contains no other person’s identifiable image without their consent.

We may, but are not obliged to, moderate, edit for length, or remove User Content that breaches these Terms, and we may remove content on a rights-holder’s valid request. We are not responsible for opinions expressed by users in User Content.

5. Bookings and financial terms

Accuracy: We may refuse or cancel a booking affected by an obvious error in price or description, even after it is submitted; if you have paid, we will refund the affected amount in full.

Currency and payment: Payments are made in Indian Rupees (INR) unless otherwise agreed, through our authorised gateway (PayU) or our official bank or UPI channels. Do not send payments to any account not confirmed by us in writing.

Convenience fee: We may charge a non-refundable convenience fee on online transactions, disclosed before you pay.

Trip terms govern: Deposits, balances, cancellations, and refunds are governed by our Terms and Conditions and Refund Policy.

6. Acceptable use

When using our website and services, you agree not to:

• impersonate another person or misrepresent your affiliation;
• use the platform to advertise or sell goods or services without our consent;
• harass, threaten, or abuse our staff, Trip Captains, partners, or other users;
• upload malicious code, attempt to gain unauthorised access, scrape, or disrupt the service;
• use the services in any way that breaks applicable law or these Terms.

We may suspend or restrict access for a material or repeated breach, acting proportionately.

7. Third-party links and services

Our website may link to third-party sites and rely on third-party services, including payment, analytics, and advertising providers. We do not control and are not responsible for their content, practices, or availability. Your dealings with them are governed by their own terms and policies.

8. Service availability and changes

We aim to keep the website available but do not guarantee uninterrupted or error-free access, and we may change, suspend, or withdraw features for maintenance, security, or operational reasons. We may correct errors, inaccuracies, or omissions in content, including pricing and availability, and update information at any time without prior notice.

9. Disclaimers

Our website and content are provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement in relation to website use. This clause does not affect the standard of care we owe in delivering booked journeys, which is governed by our Terms and Conditions, nor any rights you cannot waive by law.

10. Limitation of liability

To the fullest extent permitted by law, we and our partners and staff are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profit, revenue, or data, arising from your use of our website or services. To the extent we are found liable, our total liability connected with your use of the website or a journey is limited to the amount you paid us for the relevant journey. Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or any liability that cannot lawfully be excluded, including non-waivable consumer rights.

11. Indemnity

You agree to indemnify us against reasonable losses and costs we incur arising from your breach of these Terms, your User Content, or your unlawful use of our services. We will notify you of any claim, let you participate in the defence, and not settle in a way that imposes obligations on you without your consent, which you will not unreasonably withhold.

12. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any non-waivable rights under your local law, you and we agree that the courts of Delhi have exclusive jurisdiction over any dispute arising from or connected with these Terms or your use of our services.
