These Terms and Conditions govern the journeys you book with Komorebi Travel LLP (“the Company,” “we,” “us”) and form a binding contract between us and you, the traveler (“Guest,” “you”). They work together with our Refund Policy, Privacy Policy, and Terms of Service. By booking a journey, paying a deposit, or joining a tour, you accept these Terms on your own behalf and on behalf of everyone in your booking.
1. The contract and booking
When the contract forms: A binding contract is created when we receive your booking deposit of 50% of the package amount. Paying the deposit confirms your acceptance of these Terms and operates as your electronic signature under the Information Technology Act, 2000.
Lead booker: The person making the booking confirms they are 18 or older, authorised to act for all travelers in the booking, and responsible for sharing these Terms with them.
Balance payment: The full balance is due 20 days before departure. If it is not paid by then, we may treat the booking as cancelled, and the deposit and any non-recoverable vendor costs are forfeited under our Refund Policy. We will send at least one reminder before doing so.
Taxes and fees: Prices are exclusive of GST unless stated otherwise. Applicable GST, TCS where relevant, government levies, and payment gateway or transaction fees are payable by you in addition to the package price.
2. Scope of services
What we arrange: We design and operate curated domestic Indian journeys and selected international custom journeys. Our responsibility covers only the services expressly listed as inclusions in your itinerary.
Flights and visas: Unless your itinerary expressly says otherwise, we do not provide or assist with air ticketing or visa applications, and you are responsible for arranging your own travel to the designated starting point and for holding valid travel documents.
Third-party operators: Accommodation, transport (including Volvo and other bus services), and activities are delivered by independent third-party providers. We select partners with reasonable care, but we do not control their day-to-day operation and are not liable for their delays, mechanical issues, seat allotment, or independent acts, except to the extent caused by our own negligence.
Standards: Accommodation and facilities in remote and hill regions may not match urban or luxury-city standards. We describe what to expect honestly; differing comfort levels in such regions are not a service failure.
Itinerary changes: Routes and inclusions may need to change for weather, safety, vendor availability, or operational reasons. We will offer the nearest reasonable alternative of comparable value where this happens.
Price revision: Before departure, we may revise the price for material, evidenced increases in fuel, taxes, permit, or vendor costs. We will notify you with supporting details.
3. Cancellation, refunds, and transfers
Cancellations, refunds, rescheduling, and seat transfers are governed in full by our Refund and Cancellation Policy, which forms part of these Terms. In summary: cancellations 20 or more days before departure qualify for a 60% credit note or eligible partial refund after non-recoverable costs; cancellations within 20 days are non-refundable; and seats are transferable up to 7 days before departure subject to vendor approval. The Refund Policy governs in case of any conflict with this summary.
4. Insurance and assumption of risk
Travel insurance is mandatory. You must hold valid travel and medical insurance appropriate to your journey, including high-altitude and adventure cover where relevant. We do not provide insurance and are not liable for medical or evacuation expenses you incur.
Assumption of risk: Hill, remote, and adventure travel carries inherent risks, including altitude sickness, slips, weather exposure, and road hazards. You acknowledge and voluntarily assume these risks. This does not exclude our liability for death or personal injury caused by our own negligence, or any liability that cannot be excluded by law.
Medical fitness: You are responsible for assessing your fitness for the journey and consulting a doctor for high-altitude destinations. Tell us in advance of any condition relevant to your safety.
5. Limitation of liability
Personal belongings: We are not responsible for loss, theft, or damage to personal belongings such as electronics, cash, or jewellery, except where caused by our negligence.
Force majeure: We are not liable for changes, delays, or cancellations caused by events beyond our reasonable control, as defined in our Refund Policy. Remedies in those cases are limited to the credit note and pass-through arrangements set out there.
Cap on liability: To the extent permitted by law, our total liability arising from a journey is limited to the total amount you paid us for that journey. We are not liable for indirect or consequential losses.
Non-excludable rights: Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or any other liability that cannot lawfully be excluded, including non-waivable consumer rights.
6. On-trip conduct and safety
Authority of the trip leader: For safety and logistics, the decisions of the Trip Captain or Leader are final and binding during the journey.
Code of conduct: Abusive or harassing behaviour, illegal activity, or conduct that endangers others or the group is not tolerated. We may remove a Guest who breaches this, at their own cost and with no refund. We will act proportionately and document the reason.
Minimum group size: Journeys require a minimum of 4 participants. If the minimum is not met, we may cancel or reschedule, and you may choose a full refund or a credit note under our Refund Policy.
7. Photo and video consent
We may capture photos and video during journeys for promotional use on Instagram, YouTube, Facebook, and our website. By joining a journey you grant us a non-exclusive, royalty-free licence to use such media for these purposes. You may opt out by telling the Trip Captain at the start of the trip, or ask us afterwards to remove media where you are the main subject, as described in our Privacy Policy.
8. Complaints
If something falls short during your journey, please raise it with the Trip Captain at once so we can try to resolve it on the spot. If it remains unresolved, write to us at hello@komorebitravel.com within 14 days of the journey ending, so we can investigate while details are fresh.
9. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any non-waivable rights you hold under your local law, you and we agree that the courts of Delhi have exclusive jurisdiction over any dispute arising from or connected with these Terms or your journey.
