Terms and Conditions
Welcome to Komorebi Travel LLP (hereinafter referred to as "the Company"). These Terms and Conditions govern the relationship between the Company and the traveler (hereinafter referred to as "the Guest"). By booking a trip, paying a deposit, or participating in our tours, you agree to be bound by the terms outlined below.
The contract & booking
- Payment as Acceptance: A contract between Komorebi Travel LLP and the Guest comes into existence once a booking deposit (50% of the package amount) is received. This act serves as a digital signature of acceptance of these Terms.
- Balance Payments: Full balance must be cleared 20 days prior to departure. Failure to pay will result in automatic cancellation with forfeiture of the deposit.
- Taxes & Charges: All published prices are all-inclusive. Payment gateway or transaction fees shall be borne by the Guest.
Scope of services
- Domestic Focus: We specialise exclusively in domestic Indian travel packages.
- No VISA/Air Services: Komorebi Travel LLP does not provide or assist with VISA applications or Air Ticket bookings. The guest is solely responsible for arranging their own travel to the designated "Trip Starting Point."
- Third-Party Transport (Volvo): For trips involving transport from Delhi to Shimla/Manali, the Company utilises third-party Volvo bus service providers. The Company is not liable for bus delays, mechanical failures, or seat allotment issues.
- Confirmed Inclusions: Komorebi Travel LLP is responsible for providing only the specific items listed in the itinerary. All other snacks, beverages, or additional meals are at the traveler's own expense.
- Service Standards & Unused Services: Accommodations in hill stations may not match urban luxury standards. No refunds or price adjustments will be made for any unused services, missed meals, or sightseeing not availed by the Guest.
- Price Revision: The Company reserves the right to revise the trip price before departure in case of significant increases in fuel costs, taxes, or vendor charges.
Cancellation, refunds & replacements
- 0 – 20 Days Before Departure: 0% Refund. No monetary refund or credit note will be provided for cancellations made within this window.
- Credit Note Option: For cancellations made 20+ days prior, travelers may opt for a Credit Note worth 60% of the paid amount, valid for 6 months.
- Trip Change/Rescheduling: Any request to change the trip after the 20-day cutoff will be treated as a cancellation of the original booking. The 0% refund policy applies.
- Replacement Rule: Bookings are transferable. You may replace your seat with another person up to 7 days before departure at no extra service cost (subject to vendor approval).
- Refund Processing: Refunds or credit notes, where applicable, will be processed within 7–14 working days.
Limitation of liability
- Personal Property: The Company is not responsible for the loss, theft, or damage of personal belongings (electronics, cash, jewelry) at any point.
- Force Majeure: Komorebi Travel LLP shall not be liable for changes, delays, or cancellations caused by "Acts of God" (landslides, heavy snowfall, floods), strikes, or political unrest. No refunds are payable in these cases.
- Travel Insurance: Komorebi Travel LLP does not provide travel insurance. It is mandatory for the Guest to obtain valid travel insurance. The Company is not liable for medical expenses.
- Assumption of Risk: The Guest acknowledges inherent risks in hill travel (slips, altitude sickness, road hazards) and voluntarily assumes these risks.
On-trip conduct & safety
- Zero Tolerance Policy: Any traveler using abusive language, harassing others, or engaging in illegal activities will be immediately removed from the trip with no refund.
- Medical Fitness: It is the guest's responsibility to consult a doctor for high-altitude destinations. We are not liable for health issues arising from altitude.
- Authority of Trip Leader: The decisions of the Trip Captain/Leader regarding safety and logistics shall be final and binding on all Guests.
- Minimum Participation: Trips are subject to a minimum of 4 participants. If not met, the Company may cancel/reschedule; guests may choose a full refund or credit note.
Photo & video consent
The Company reserves the right to use photos and videos taken during the trip for promotional purposes. The Guest grants a perpetual, royalty-free license for use on YouTube, Instagram, and Facebook. Notify the Trip Captain at the start to opt-out.
Jurisdiction
Any disputes, claims, or legal proceedings shall be subject to the exclusive jurisdiction of the courts in Delhi only.
